Terms of Service

1.1 "Voice Clone" means a synthetic voice model created from audio samples you provide that replicates vocal characteristics.

1.2 "Voice Sample" means any audio recording you upload or provide to the Service for the purpose of creating a Voice Clone.

1.3 "Generated Audio" means any audio content produced by the Service using a Voice Clone or other text-to-speech (TTS) functionality.

1.4 "Biometric Voice Data" means voice recordings and derived voice models that may constitute biometric data under applicable law.

1.5 "Subscription Plan" means a paid tier (BASIC or PRO) granting access to enhanced Service features as described in Section 6.

1.6 "Free Tier" means the no-cost access level offering one (1) Voice Clone and up to three (3) minutes of Generated Audio.

1.7 "Content" means any text, audio, voice samples, or other material you submit to or generate through the Service.

2.1 Age Requirement. You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement.

2.2 Account Accuracy. You agree to provide accurate, current, and complete information when creating an account or interacting with the Service via Telegram or WhatsApp. You are responsible for maintaining the confidentiality of your account credentials.

2.3 One Account Per User. Creating multiple accounts to circumvent Free Tier limits or any restriction is prohibited and may result in termination of all associated accounts.

2.4 Business Users. If you use the Service on behalf of a company or legal entity, you represent that you have the authority to bind that entity to these Terms.

3.1 Ownership and Permission Requirement. You may only upload Voice Samples of: (a) your own voice; or (b) a third party's voice for whom you have obtained prior, explicit, written consent from that individual specifically authorizing the creation of a Voice Clone for your intended use.

3.2 Prohibited Voice Cloning. You are strictly prohibited from cloning, replicating, or imitating the voice of any person without their informed and documented consent. This includes, without limitation: public figures, celebrities, politicians, or executives; deceased individuals; minors under any circumstances; any person for the purpose of deception, fraud, or impersonation.

3.3 User Assumes Full Legal Responsibility. You are solely and fully responsible for ensuring you have all necessary rights, consents, and permissions before uploading any Voice Sample. BlockSands AI does not verify consent and bears no liability whatsoever for your use of Voice Clones. Any legal claims, regulatory actions, or third-party disputes arising from unauthorized voice cloning are your sole responsibility.

3.4 Consent Documentation. We strongly recommend you maintain written records of consent obtained from third parties. We may require you to provide such documentation upon request. Failure to produce evidence of consent may result in immediate account termination.

3.5 Biometric Data Acknowledgment. You acknowledge that Voice Samples and Voice Clones may constitute biometric data under applicable laws, including LGPD and GDPR. By submitting a Voice Sample, you expressly consent to our processing of this data as described in these Terms and our Privacy Policy.

4.1 The following uses are strictly prohibited and will result in immediate account termination and potential legal action:

• Cloning any voice without the explicit consent of the voice owner.
• Using Generated Audio to impersonate any individual for deceptive, fraudulent, or harmful purposes.
• Creating deepfake audio designed to mislead, manipulate, defraud, or harm any person or entity.
• Using the Service to generate content that defames, harasses, threatens, or violates the rights of any individual.
• Producing Generated Audio that constitutes disinformation, political propaganda, or manipulated media intended to deceive the public.
• Generating audio for use in scams, phishing, social engineering attacks, or any form of financial fraud.
• Creating content that is sexually explicit without lawful basis, or any content that sexualizes minors.
• Violating any applicable local, national, or international law or regulation.
• Attempting to reverse-engineer, copy, extract, or replicate our AI models or proprietary systems.
• Using the Service to train competing AI models or datasets.
• Circumventing access controls, rate limits, or subscription restrictions through technical means.
• Reselling or sublicensing access to the Service without our prior written authorization.

5.1 Company Ownership. All rights in the EchoLang AI platform, underlying AI models, software, algorithms, interfaces, branding, and technology are owned exclusively by BlockSands AI.

5.2 Your Content. You retain ownership of Voice Samples you upload. By uploading Voice Samples, you grant BlockSands AI a limited, non-exclusive, worldwide, royalty-free license to process, store, and use that data solely to provide the Service to you.

5.3 Generated Audio. Subject to your compliance with these Terms, you own the Generated Audio you create. We retain a non-exclusive license to use anonymized, aggregated Generated Audio for model improvement and quality assurance.

5.4 Voice Clone Models. The technical Voice Clone model stored on our infrastructure may be deleted upon request. We do not sell or transfer your Voice Clone models to third parties except as described in our Privacy Policy.

5.5 Feedback. Any feedback or suggestions you provide may be used by us freely without obligation or compensation.

6.1 Available Plans.

6.2 Billing and Renewal. Subscriptions are billed in advance and automatically renew unless cancelled before the renewal date. You authorize us, via Stripe, to charge your payment method at the start of each billing period.

6.3 Price Changes. We will provide at least 30 days' advance notice of any price increase. Continued use after the change takes effect constitutes acceptance.

6.4 Cancellation. You may cancel at any time. Your subscription remains active until the end of the current billing period. No partial refunds for unused time.

6.5 Refund Policy. All fees are non-refundable except: (a) where required by applicable consumer protection law; (b) where the Service was materially unavailable for more than 72 consecutive hours due to our fault; (c) documented billing errors. Refund requests must be submitted within 14 days to support@echolang.ai.

6.6 Taxes. Prices are exclusive of applicable taxes. You are responsible for taxes in your jurisdiction.

6.7 Failed Payments. Access may be suspended or downgraded to Free Tier if payment cannot be collected within a reasonable grace period.

• Free Tier: $0, 1 Voice Clone, 3 min audio.
• BASIC: $5.99/month or $49.99/year, enhanced limits.
• PRO: $14.99/month or $119.88/year, maximum limits, all features.

7.1 No Uptime Guarantee. The Service is provided "as available." We make commercially reasonable efforts to maintain high availability but are not liable for downtime or interruptions.

7.2 Feature Changes. We reserve the right to modify, suspend, or discontinue any feature at any time. Material changes to paid features will be communicated with reasonable advance notice.

7.3 Fair Use. Automated high-volume usage that disrupts service for other users may result in throttling or suspension.

7.4 Third-Party Dependencies. We are not responsible for outages or disruptions caused by Telegram, WhatsApp, or other third-party platforms.

8.1 Legal Basis. We process your personal data, including Biometric Voice Data, under LGPD (Law 13,709/2018) based on: your explicit consent (Art. 7, I and Art. 11, I); performance of contract (Art. 7, V); legal obligations (Art. 7, II).

8.2 Your Rights Under LGPD. You have the right to: confirm and access your data; correct inaccurate data; delete data processed with your consent; port your data; revoke consent at any time; file complaints with the ANPD.

8.3 Data Retention. We retain Voice Samples and Voice Clone models for as long as your account is active plus 90 days. Upon account deletion, biometric data is deleted within 30 days.

9.1 Legal Basis. For EEA users, we process personal data under GDPR based on: explicit consent (Art. 6(1)(a) and Art. 9(2)(a) for biometric data); contract performance (Art. 6(1)(b)); legitimate interests (Art. 6(1)(f)).

9.2 Your Rights Under GDPR. You have the right to: access, rectify, or erase your data; restrict or object to processing; data portability; lodge complaints with your local supervisory authority; withdraw consent at any time without affecting prior processing.

9.3 International Transfers. Your data may be processed outside the EEA. We implement appropriate safeguards, including Standard Contractual Clauses or equivalent, for such transfers.

10.1 Termination by You. You may delete your account at any time by contacting support@echolang.ai. Upon deletion, your Voice Clones and personal data will be deleted within 30 days.

10.2 Termination by Us. We may suspend or terminate your account immediately, without prior notice or refund, if you: violate these Terms; engage in fraudulent or illegal activity; create risk or legal exposure for us or other users; fail to pay subscription fees.

10.3 Effect of Termination. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination, including Sections 3, 4, 5, 11, 12, and 13, shall survive.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATED AUDIO WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BLOCKSANDS AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR USD $50, WHICHEVER IS GREATER.

13.1 Governing Law. These Terms are governed by and construed in accordance with the laws of the Emirate of Dubai and the applicable federal laws of the United Arab Emirates, without regard to conflict of law principles.

13.2 Dispute Resolution. Any dispute arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the exclusive jurisdiction of the courts of Dubai, UAE.

13.3 Class Action Waiver. To the extent permitted by applicable law, you waive any right to participate in class action lawsuits or class-wide arbitration against BlockSands AI.

We reserve the right to modify these Terms at any time. We will notify you of material changes via Telegram/WhatsApp notification or email at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service.
